Purpose and Scope
These general terms of sale (hereinafter "the Terms") govern the relationship between Dive With Lau — Laurent Larfa, PADI diving instructor (hereinafter "we") — and any person booking a service (hereinafter "the Client"): discover scuba dive, PADI course, guided dive, diving outing or trip.
Any booking implies unreserved acceptance of these Terms, which prevail over any other conditions. We reserve the right to amend them at any time; the applicable Terms are those in force on the day of booking.
Services
We offer discover scuba dives, courses in accordance with PADI standards (from Open Water Diver to Divemaster), guided dives, and diving outings and trips, notably in Belgium, Tenerife (Spain), Malaga (Spain) and Greece. Depending on the package, the theory portion may be completed online (PADI eLearning) and the dives carried out at the service location. Courses take place in small groups.
The precise content of each service (number of sessions, location, equipment included, prerequisites) is detailed in the quote or booking confirmation.
Prices and Quotes
As our services are tailor-made, prices are communicated on request, in the form of a quote provided by phone, email or via the contact form. Prices are in euros, all taxes included. A quote is valid for the period stated on it; failing that, 30 days. Unless otherwise stated, the quote does not include the Client's personal expenses (transport, accommodation, meals, individual insurance, third-party certification fees where applicable).
Booking and Payment
Bookings are made by phone, email, WhatsApp or via the website contact form. A booking becomes firm upon receipt of a deposit of 50% of the price of the service, unless otherwise agreed in writing. The balance is payable no later than the day of the service or, for courses with several sessions, before the last session.
Payments are made by bank transfer or any other means agreed together.
Right of Withdrawal
For bookings concluded at a distance, consumer Clients have a withdrawal period of 14 calendar days from the conclusion of the contract, in accordance with Book VI of the Belgian Code of Economic Law.
This right does not, however, apply to leisure activity services to be provided on a specific date or period (Art. VI.53, 12° of the Code of Economic Law). Furthermore, if the Client asks for the service to begin before the end of the withdrawal period (for example, activation of PADI eLearning access), they acknowledge losing their right of withdrawal for the portion already performed.
Cancellation or Rescheduling by the Client
- More than 48 hours before the service: rescheduling to a later date is offered free of charge, subject to availability;
- Less than 48 hours before the service, or in the event of no-show or a delay making the service impossible: the service is due and the deposit is retained;
- A service that has started (course begun, trip underway) is not refundable, even if interrupted by the Client;
- In the event of cancellation for a justified medical reason supported by a certificate, rescheduling or a credit note is offered.
Any cancellation must be notified in writing (email or message).
Cancellation or Modification by Dive With Lau
Diving depends on natural conditions. We may cancel, postpone or modify a service (location, dive site, schedule) for reasons of safety, weather or sea conditions, or for technical or group-size reasons.
- In the event of unfavourable conditions, rescheduling is offered as a priority;
- If no rescheduling is possible, sums paid for services not provided are refunded in full;
- Cancellation or rescheduling gives no right to compensation beyond the refund of sums paid (excluding the Client's transport, accommodation or other personal expenses).
Medical Fitness
Scuba diving requires good physical condition. Before any activity, the Client completes the current PADI medical questionnaire. Where the questionnaire so requires, a medical certificate of fitness to dive, less than one year old and issued by a physician, is mandatory before entering the water.
The Client undertakes to declare their state of health truthfully. Any false statement or omission engages their sole responsibility and may result in refusal of the service without refund.
Minors
Minors may only participate with the written authorisation of a parent or legal guardian, and subject to the minimum ages set by PADI standards for each activity. Outside supervised activities, minors remain under the responsibility of their parents or accompanying adults.
Equipment
The equipment included in the service is specified in the quote. The Client undertakes to use the equipment provided with care and to report any anomaly immediately. Loss of or damage to the equipment provided (beyond normal wear and tear) is charged to the Client at the cost of repair or replacement.
The Client may use their own equipment, provided it is suitable, in good condition and compliant; the instructor may refuse any equipment deemed non-compliant or dangerous. Using personal equipment does not entitle the Client to any discount.
Client Obligations
- Present, on request, original diving certifications and logbook;
- Respect the agreed schedule — a delay cannot be made up and may count as a no-show;
- Strictly follow the instructor's safety instructions and briefing;
- Not be under the influence of alcohol or drugs;
- Respect the safety intervals before flying after diving, as communicated.
The instructor may exclude from the activity, without refund, any participant whose behaviour compromises their own safety or that of the group.
Course Certification
Certification is never automatic: it is conditional on passing the exercises and demonstrating the skills required by PADI standards. If the required level is not reached at the end of the planned sessions, additional sessions may be offered; their price is communicated in advance. Refusal of certification for safety reasons or failure to meet the standards gives no right to a refund.
Insurance and Liability
We are covered by professional liability insurance. Clients are strongly advised to take out individual diving insurance covering diving accidents (for example DAN Europe), as well as cancellation/travel insurance for trips.
We decline all responsibility for loss, theft or damage to the Client's personal belongings. We cannot be held liable for damage resulting from the Client's failure to follow safety instructions, a false medical declaration or improper use of equipment.
Trips
For diving trips, services provided by third parties (transport, accommodation, partner dive centres) are subject to those providers' own conditions. The specific conditions of each trip (content, deposit, specific cancellation deadlines) are set out in the quote and, for that trip, prevail over these Terms in the event of any inconsistency.
Image Rights
Photos or videos may be taken during activities. They are used for promotional purposes (website, social media) only with the Client's consent, which may be withdrawn at any time by simple request to laurent.larfa@gmail.com.
Personal Data
The Client's personal data is processed in accordance with our Privacy Policy.
Complaints, Applicable Law and Disputes
Any complaint must be sent in writing to laurent.larfa@gmail.com within 7 days of the service concerned. We endeavour to resolve any dispute amicably.
Consumer Clients may also turn to the Belgian Consumer Mediation Service (mediationconsommateur.be) or the European Online Dispute Resolution platform (ec.europa.eu/consumers/odr).
These Terms are governed by Belgian law. Failing an amicable resolution, the courts of the judicial district of Brussels have jurisdiction, subject to mandatory consumer protection provisions.
